Terms and conditions

Terms and conditions for consumers

1. About us

The online store at barkonsult.se is operated by BARKONSULT Jakobsson & Lövgren Aktiebolag (Barkonsult), company registration number 556590-3274, Upplagsvägen 25, 117 55 Stockholm, Sweden. You can reach us on +46 (0)8-644 60 40 or info@barkonsult.se, weekdays 08:30–17:00.

2. Scope

These terms apply when you shop as a private individual. In addition, the Swedish Consumer Sales Act (2022:260) and the Swedish Distance and Off-Premises Contracts Act (2005:59) apply. These terms never limit your rights under mandatory law. You can read more about your rights at the Swedish Consumer Agency, konsumentverket.se.

We only deliver to addresses in Sweden.

3. Prices

All prices are in Swedish kronor (SEK) including VAT. Shipping costs are added and shown before you complete your purchase.

If a price is obviously incorrect, for example due to a typo, and you realised or should have realised this, we have the right to cancel the purchase. We will tell you why and refund any amount you have paid.

4. Orders and payment

The contract is formed when you receive our order confirmation by email. Please check that the details are correct.

Payment is handled by Shopify Payments. The available payment methods, such as card, Apple Pay, Google Pay and Klarna, are shown at checkout. We do not charge a fee for card payments. If you choose to pay with Klarna, you enter into an agreement with Klarna, and Klarna's terms apply to the payment, including due dates and any late payment interest.

5. Delivery

Orders received before 12:00 Monday–Thursday are processed the same day. Orders received Friday–Sunday are processed the following Monday. Standard delivery time is 5 working days.

We deliver via DSV to your nearest pickup point. You will receive a text message when your parcel has arrived. Shipping costs SEK 99 including VAT per order. Parcels to pickup points can weigh up to 20 kg, so a larger order may be split into several parcels and you may receive several text messages.

You can also choose to collect your order from our shop in Stockholm. It is normally ready for collection within 24 hours, and we will email you when it is ready.

If your delivery is delayed, we will contact you. If the delay is of significant importance to you, you have the right to cancel the purchase under the Consumer Sales Act.

6. Changing or cancelling an order

Contact us as soon as possible if you want to change or cancel an order. We can change or stop an order that has not yet been packed. We can remove products but not add them; to add something, please place a new order. Once the order has been shipped, your right of withdrawal under section 7 applies instead.

7. Right of withdrawal

You have the right to withdraw from your purchase within 14 days from the day you, or someone you have appointed, received the goods. If an order is delivered in several parcels, the period starts on the day you received the last one.

You can withdraw from your purchase using the withdrawal function at barkonsult.se/pages/cancel-order, by emailing info@barkonsult.se, or by using the Swedish Consumer Agency's standard withdrawal form. You do not need to give a reason.

Return the goods no later than 14 days after notifying us of your withdrawal. Please contact us first so we can give you return instructions. You pay for the return shipping.

We will refund what you have paid, including the original cost of standard delivery, no later than 14 days after receiving your notice. We may withhold the refund until we have received the goods back, or until you have shown that you have sent them. The refund is made using the same payment method you used.

You may examine the goods in the same way as you would in a shop. If you have handled them beyond that and they have lost value as a result, we may deduct the loss in value. Pack the goods carefully so they are not damaged on the way back.

The right of withdrawal does not apply to:

  • goods made or adapted to your specifications
  • goods that can deteriorate or expire quickly
  • sealed goods that are not suitable for return for health or hygiene reasons, if the seal has been broken after delivery, for example opened food and beverages

8. Complaints

If a product is faulty, you have the right to make a complaint under the Consumer Sales Act. You can complain about faults that existed when you received the goods for three years. A fault that appears within two years of delivery is presumed to have existed at delivery, unless this is incompatible with the nature of the fault or the product.

Notify us within a reasonable time after discovering the fault. Notice within two months is always considered reasonable. Contact us at info@barkonsult.se or +46 (0)8-644 60 40 with your order number and a description of the fault. We will send you a return number and a prepaid shipping label.

For an accepted fault, we pay for the return shipping and may, depending on the situation, repair or replace the product, give a price reduction or cancel the purchase. If an identical product is not available, we may offer an equivalent one.

If, after examination, we cannot find a fault that we are responsible for, we may charge SEK 250 including VAT plus shipping costs both ways. We will inform you of this before you send the product in.

9. Transport damage

We are responsible for the goods until you have received them. If a product has been damaged in transit, contact us as soon as possible, preferably within a week, with photos of the packaging and the damaged product. This does not affect your rights under section 8.

10. Uncollected parcels

If you do not collect your parcel within 14 days, it is returned to us. We then charge a fee of SEK 312.50 including VAT to cover our shipping and administration costs. The fee does not apply if you have exercised your right of withdrawal.

11. Retention of title

The goods remain the property of Barkonsult until they have been paid for in full.

12. Liability

Our liability for faults and delays follows the Consumer Sales Act. We are not liable for indirect damage, such as loss of income or data, unless we have been negligent or mandatory law provides otherwise.

13. Force majeure

We are not liable for delays or failure to deliver caused by circumstances beyond our control that we could not reasonably have foreseen, such as war, natural disaster, strikes, decisions by authorities or failure to deliver by a supplier. We will inform you as soon as possible if such an event affects your order. You always have the right to cancel the purchase if the delay is significant.

14. Personal data

We process your personal data in accordance with our privacy policy.

15. Changes to these terms

We may update these terms. The terms in force when you placed your order apply to that order.

16. Disputes

If you are not satisfied, please contact us first and we will try to find a solution. If we cannot agree, you can turn to the National Board for Consumer Disputes (ARN), Box 174, 101 23 Stockholm, arn.se. Barkonsult follows ARN's recommendations. Otherwise, disputes are settled by a Swedish general court under Swedish law.

Terms and conditions for business customers

1. Scope

These terms apply to purchases made by companies and other legal entities from BARKONSULT Jakobsson & Lövgren Aktiebolag, company registration number 556590-3274 (Barkonsult). By placing an order, the customer accepts these terms. They take precedence over the customer's own purchasing terms unless otherwise agreed in writing. The Swedish Consumer Sales Act does not apply to business purchases.

2. Prices

Prices for business customers are stated excluding VAT unless otherwise indicated. Shipping is added according to the applicable delivery terms.

3. Credit checks and payment terms

Barkonsult reserves the right to run credit checks on new and existing customers and to set individual payment terms per customer. Unless otherwise agreed, payment terms are 20 days net from the invoice date. Late payments are charged interest under the Swedish Interest Act (reference rate + 8 percentage points) plus statutory reminder and collection fees.

4. Delivery

Delivery is made as agreed and according to the applicable delivery terms. Stated delivery times are indicative. Barkonsult is not liable for delays caused by circumstances beyond our control.

5. Complaints

Faults or defects must be reported in writing within a reasonable time, and no later than 7 calendar days after receipt of delivery. Visible transport damage must be noted on receipt.

6. Returns

  1. Returns must always be reported to the responsible sales representative, who will respond in writing within two (2) working days.
  2. Returns may not be sent without the sales representative's written approval. Goods sent without approval will not be accepted.
  3. Returns are accepted no later than 30 calendar days after the delivery date.
  4. Approved returns are charged a return fee of 15% of the goods' value.

Barkonsult may make exceptions to points 1–4 where there is reason to do so or where otherwise agreed in writing before the purchase. The return fee does not apply to faulty goods.

7. Retention of title

Delivered goods remain the property of Barkonsult until payment has been received in full.

8. Limitation of liability

Barkonsult's liability is limited to direct damage up to the invoiced amount of the goods. Indirect damage, such as loss of production, loss of profit or other consequential loss, is not compensated, except in cases of gross negligence or intent.

9. Force majeure

Barkonsult is released from its obligations if they are prevented or made significantly more difficult by circumstances beyond Barkonsult's control that could not reasonably have been foreseen, such as war, natural disaster, industrial action, decisions by authorities or failure to deliver by a supplier.

10. Disputes and governing law

Disputes arising from these terms shall first be resolved through negotiation. If the parties cannot agree, the dispute shall be settled by a Swedish general court, with Stockholm District Court as the court of first instance, under Swedish law.
